Terms of use

Courtesy translation. This English text is provided for your convenience. The legally binding version is the German one: Nutzungsbedingungen. The German text also covers the operator's other services.

1. Scope

(1) These terms of use govern the use of CitedBy at www.citedby.de, operated by mxw-it, owner Maximilian Wiese, Am Jördenberg 9a, 23812 Wahlstedt, Germany (the "Operator"). By using the service you accept these terms of use.

(2) The terms of sale take precedence for paid subscriptions. The terms of the provider Paddle, which acts as contract partner in this respect, also apply to the purchase contract for a subscription.

2. Purpose of the service

CitedBy is an application with a free entry offer and paid plans. The application is in a beta phase.

3. The application

(1) CitedBy processes the business details you enter on the server and stores the results. The privacy notice sets out which data is processed in detail.

(2) The service is provided without warranty of availability, freedom from errors or particular properties and can be changed or discontinued at any time. There is no right to use it. The differing rules of the terms of sale apply to paid subscriptions.

(3) The evaluations in CitedBy are generated by an AI language model, not a person. Answers and evaluations generated by AI language models can be incomplete or wrong and differ when a query is repeated. They are not legal, tax or business advice and are not suitable as the sole basis for a decision.

4. Copyright and scope of use

(1) All content of the service (text, graphics, screenshots, source code, design) is protected by copyright. Unless marked otherwise, the rights holder is the Operator.

(2) You may retrieve and display the content for personal use and set links to the service. Any further use, in particular reproduction, editing, distribution or making available to the public, requires the Operator's prior written consent.

(3) You may use reports and evaluations generated through CitedBy without restriction for your own purposes, including sharing them within your business and with your customers.

(4) Third-party brand and product names mentioned on the service are the property of their respective owners and are used descriptively only.

5. Availability

The Operator strives for uninterrupted availability but accepts no warranty for it. Maintenance, further development or faults, including at third parties such as the hosting provider or the AI services used, can lead to temporary restrictions.

6. Prohibited use

(1) Any use that may impair the functioning or security of the service is prohibited, in particular automated mass requests, attacks on the infrastructure, injecting malicious code and systematically extracting content (scraping) for commercial purposes without the Operator's consent.

(2) It is also prohibited to circumvent the usage limits of free offers, for example by repeatedly creating accounts or using changing email addresses in order to use free quotas several times.

(3) You must not enter personal data of third parties or confidential information in text fields, because these entries are passed on to the AI services used.

(4) In the event of a breach the Operator may block access to the service.

7. External links

The service contains links to external third-party websites. The respective provider alone is responsible for their content; no legal violations were apparent at the time of linking. The notes in the legal notice apply (liability for links).

8. Liability

For free use of the service the Operator is only liable for intent and gross negligence and without limitation for damage from injury to life, body or health. In the case of simple negligence the Operator is only liable for breach of essential obligations, limited to foreseeable, typical damage. The content was created with care; no warranty is given for accuracy, completeness or currency. For paid services, section 3 of the terms of sale applies.

9. Data protection

Information on the processing of personal data can be found in the privacy notice.

10. Changes; final provisions

(1) The Operator reserves the right to change these terms of use with effect for the future. The version published at the time applies.

(2) The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.

(3) If individual provisions are invalid, the validity of the remaining provisions is unaffected.
